- We will do an identical marks search of the USPTO database
- All gigs include US attorney representation and monitoring
- If you want everything to be included, buy middle or premium package. The only 2 things not included are responses to confusion/descriptiveness objections and oppositions (rare).
- Premium package includes help with Brand Registry. Important for Amazon sellers.
Responses to any objections are not included in the basic gig.
Basic:
Preparating and filing your TM app. in one class. US attorney on file. Monitoring and reporting progress included.
Middle:
US attorney files your TM app. Monitoring the progress. Handles all objections except confusion and descriptiveness.
Premium:
US attorney files your TM app. Monitoring the progress. Handles all objections except confusion and descriptiveness. Help with Amazon Brand Registry application process.
Not included:
Statement of use filing
Professional fees for more than 1 class (unless extra gigs purchased).
All gigs will be considered as "completed" once your TM application is submitted. We will stay in touch after filing. You can also monitor your trademark online.

Where can you file?
We can file in Canada, EU, UK, Australia, China and the US. This gig is for the US filings only.
When will my trademark register?
It takes about 8-12 months to register a trademark in the US provided there are no office actions (objections from the USPTO).
Can you help me further down the road?
You bet! We can submit office action responses, prepare and submit your Statement of Use, file post-registration maintenance documents, etc. Contact me for further details. Standard and Premium gigs include some additional features already (maintaining your trademark, responding to office actions).
What is a trademark class?
All products and services are broken down in classes. Most common classes: electronic publications or software-cl 9, printed publications and books-cl 16, clothing-cl 25, advertising or business services-cl 35, educational and entertainment services-cl 41, science and technological services-cl 42.
Who pays government fees?
You will be responsible for the Trademarks Office filing fees of US$350 per class (payable at submission).
Can we talk on the phone?
Yes, a phone consultation is available with the purchase of any gig.
Do you provide legal advice?
No legal advice is provided with these packages.
Are you an attorney?
I am a Canadian trademark agent. My company employs a US trademark attorney who will be attorney responsible for your application. All applications are reviewed and filed by our US attorney.
Do you do a search before you file?
Yes, we do a direct hit search for identical marks. We recommend a full trademark search (buy standard gig here: https://www.fiverr.com/share/jK4jo)
Why should I buy middle or premium gig?
They include unlimited responses to administrative objections. These are common. If you get MIddle or Premium gig, you will not be charged extra if there is an office action. Complex office actions - confusion/descriptiveness will be extra cost. Premium gig includes help with Brand Registry.
