You can file a provisional patent application in the Unites States, and enjoy the benefit of its priority date in a later filed non-provisional U.S. application. The later filed application must be filed within twelve months of the filing of the provisional application.
There are several reasons why an inventor might choose to file a provisional patent application prior to filing a Utility Patent Application. First, a Provisional Patent Application is typically less complicated and less expensive to prepare than a Utility Patent Application. Second, it establishes a filing date and provides an opportunity to further develop, design and market the invention before a Utility Patent Application would need to be filed. Third, it allows you to claim "Patent Pending" status. Given the potentially important nature that
the Provisional Patent Application can play in the process, the responsibility of prompt and proper filing should be taken seriously by the inventor.
